Administrative License Hearings

Fight License Suspension

When an officer charges you with driving under the influence (DUI), you are issued a slip of paper (Pink in Kansas and White in Missouri) informing you that your license will be suspended if you do not request an administrative hearing within a specific number of days of your arrest and charge. In Kansas, you must request an administrative license hearing within 14 days of your arrest; in Missouri, you must make the request within 15 days (if you refuse in Missouri you have 30 days to file a Petition). Kansas residents who receive the notice of suspension by mail may have an additional three days to respond; however, it is advisable to respond within the initial two-week period as well as consult with a DUI attorney as soon as possible. Call us today and Paul W. Burmaster will help you request your hearing for free. License suspension can have a serious negative impact on your ability to get to and from work, school, the grocery store, and other important places, so at Paul W. Burmaster, PA, we strongly encourage you to consult with a Kansas City DUI attorney right away if you've been arrested for drunk driving.

Administrative Hearing Process

As stated before, you have only two weeks after your DUI arrest to request an administrative license hearing. Your license will be suspended if you fail to request the hearing within the allotted time frame. At the hearing, your case will be heard by an administrative judge with the Department of Revenue. You are allowed legal representation and will be able to present your defense before the administrative judge. Your attorney may also cross-examine your arresting officer to provide further evidence and defend you from license suspension. Attorney Paul Burmaster has more than 20 years of DUI defense experience, so contact the firm now to learn what our firm can do for you.
