If you have been charged with DUI in Kansas, you have 10 days (excluding Saturdays, Sundays and Legal Holidays) to request an administrative hearing or your license will be suspended. If you have been charged with DUI in Kansas, you will receive a suspension notice from the arresting officer (the pink form). In order to keep your driving privileges, you must request an administrative hearing to contest the suspension. If you fail to request a hearing, your license will be suspended. This suspension may be for 30 days, for 1 year, 2 years, 3 years or even longer.  You may also be required to install an ignition interlock device on any car you operate. This will depend on a number of factors.

Hearings are conducted before an administrative judge from the Department of Revenue. The police officer should be present and your lawyer will get an opportunity to cross-examine him.

The diversion trap and your drivers license
We have been told by clients many times that the arresting officer said, "You don't need an attorney." While it is true that in some cities you can resolve the DUI charge by diversion without counsel, it may not be in your best interest.

Diversion is an agreement where charges may be dismissed upon completion of certain conditions. However, diversion only addresses the criminal charge. Diversion does not resolve the drivers license matter. As a result of poor advice, many people do not seek an attorney. After they sign up for diversion they receive two letters in the mail. One says their license is suspended. The other says their rates have gone through the roof or that the insurance company has dropped them.
